Nick Emery reinstated, suspended for first 9 games

Former Lone Peak High star Nick Emery has been reinstated by the NCAA and BYU for the 2018-19 basketball season, the university announced Thursday afternoon.



As part of the BYU Athletic Department’s review of the reinstatement request, Emery will be required to sit out the first nine games of the year. He will be allowed to join the program for summer conditioning prior to the 2018-19 academic year.



Emery, who will be a junior this fall, withdrew from school prior to the 2017-18 season as the school was undergoing an NCAA investigation involving alleged improper benefits between the sharpshooter and a perceived booster of the basketball program.



At the time of his departure, Emery also cited "personal reasons" that included a divorce from his ex-wife Sarah.



The news hardly comes as a surprise for BYU coach Dave Rose and Emery, the 6-foot-2 sharpshooter who averaged 14.7 points, 2.5 assists and 3.3 rebounds per games in two seasons for the Cougars. He returned from a two-year mission for The Church of Jesus Christ of Latter-day Saints in Germany and quickly became a starter, becoming the fourth BYU player to reach 1,000 career points as a sophomore in 2016-17.

Good news for Nick that this is now pretty much figured out.

Yeah, 9 games seems a little harsh, but I suppose we don't know all the details. But it's really hard to impossible to believe that this could be worse than an entire university creating fake classes with basketball coaches dictating the fake grades to be given basketball players in those classes. Still, it's not as terrible as what some were imagining would happen. I'd heard speculation (mostly from utes) about multiple years probation for the program, post-season bans, loss of scholarships, etc. I never thought it would be that bad.



It seems Emery is getting his life back together, which I'm glad about. Still seems pretty low class what his exes tried to do to him with this.

The punishment seems pretty fair to me. I was expecting approximately 10 games, so this fell exactly in line with what I thought.



I hope it's a good lesson to other athletes. Do not take expensive gifts from boosters, even if they are family acquaintances. Also, if you are going to take gifts, don't take really lame gifts because then you look even dumber.

good points. Athletes should know better. They do, but this is a good reminder.

Time and facts did not help him out. Good to have a punishment handed down, so he can complete it and put it behind him.

Punishment would have been worse if the infractions had been cooler.

Nice to have the investigation in the rear view and get the issues behind him. If he got 9 games there must have been cause. From the sound of it he reimbursed the infractions but that they happened in the first place resulted in the individual penalty. Does this mean the SlTrib reporters will now stop hiding in vehicles in the practice facility parking lot with their binoculars trying to catch people doing something?

There was an interesting comment from Jay Drew when he was on the radio the other day. He said when he worked for the Tribune there was an employee at the Sherrif's office that hated BYU, so anytime a player got any kind of legal trouble he would send all the info to the reporters.



Kind of lame to do that, in my humble opinion.

Well the Trib is down a man now, so I'd be shocked if they had anyone to sit around in a car any more.

So the fact that he took himself out for a whole season doesn't figure in? I know they didn't make him leave, and maybe he would have left even without this hanging over him, but when he did, I was of the belief that the nine games could be counted against that time. I don't know. I guess I'm in the minority of believing that his sitting out a year should have any value toward a punishment.

Absolutely not. I honestly don't see any way in which removing yourself from being investigated and punished would count towards a self-imposed punishment.

So you're saying that had these issues with a booster not surfaced that you believe that Nick would have played last season?



If that is the fact of the matter, then I'm in agreement, but not knowing anything specific, but making a deduction, I believe he wasn't attempting only to remove himself from being investigated. There would have been an investigation regardless because when these events occur, it's not only the student that is investigated, but the program. Suspending him for 9 games is a penalty against him personally, but also against the university. The word last year, after the withdrew from school, was that the investigation was put on the back burner due to other hotter issues, but it didn't go away.

I don't believe people should be rewarded for attempting to evade punishment.

Yes, he would have played last season if his accepting illegal benefits hadn't come to light.



As for the investigation, Nick could not be investigated nor punished by the NCAA or by BYU once he was no longer affiliated with both. BYU could be investigated by the NCAA, but they will give the school the chance to do an internal investigation and self-imposed punishment in most cases. It was only once Nick applied to be reinstated that BYU (and the NCAA, if they wished) could begin investigating and set any kind of punishments.



The 9 games is more than fair for what Nick did. His leaving school to get his divorce and mental state taken care of was apparently much needed and helpful for him, so I'm glad for that, but in no way does it take the place of a punishment.

Had Emery stayed with BYU and the NCAA and then voluntarily sat out while still on the team, then that would have been a self-impossed punishment. Instead, he withdrew from the team.



Let's say you have a bunch of parking tickets. Moving out of state avoids you having to pay the parking tickets. If you were to move back, shouldn't you pay the parking tickets that you owe?

I hear you guys, but to me in your example, if you left your car back in Utah, then you were assessing yourself a punishment. Nick setting his basketball career back one year is no small thing. I guess we just have to agree to disagree.

I'm honestly surprised it's just 9 games. I would think the NCAA would have come down harder on him. Let's be honest adults here -- he didn't leave school for an emotional respite after his divorce or to say "my bad" and take it upon himself to atone for his impermissible benefits. He did it to remove himself from the NCAA's jurisdiction so that he did not have to cooperate with the investigation to the same extend he would have to as an enrolled student athlete. He was actively making the process more difficult for the NCAA to get to the bottom of what happened.



I think Emery is beside himself with glee that he is getting off this easy.
