The "Cougar Corner" name issue would more likely fall under trademark infringement, then copyright. As far as I know, this site is not a commercial venture, so trademark protections are probably unavailable. :sulk:

Although, the "Cougar Corner" name is available for registration with the USPTO. ;)

IP Law is not my bag. BUt willing to bet that if it is used enough already by many groups for commercial use, it will be Fair Use not subject to trademark.

I'm more of a patent person myself, but from my understanding from the few trademark litigation matters I've worked on, all groups using the mark will have some common law trademark rights in the mark, but they would be limited in scope. If our Cougar Corner were to apply for a federal registration--which would explicitly establish a national scope of use, Wazzu's use prior to filing would most likely allow it to continue its use but not expand the scope of its use.
