Because states ceded some of their sovereignty to form the federal government, those elections were never meant to be a result of a popular vote, but a result of what the states decided. Senators were elected by the legislatures until we changed it to the popular vote, and some states did not even elect their electors for the electoral college...they were appointed. The founders very much feared direct democracy for good reason.
Ninety-five percent of the lawyers make the other five percent of us look bad.
