"Shurtleff... has met with U.S. Attorney General Eric Holder and Christine Varney, who heads the Department of Justice’s antitrust division, and is trying to persuade the federal government to join his cause... He points out that an antitrust ruling against the BCS would bring a judgment of triple damages that could run into the hundreds of millions of dollars. Shurtleff knows the mere threat of such a judgment might be enough to pressure college football into some kind of playoff system. He repeatedly says he hopes the BCS problem is solved without legal action, but says he is willing to go through with an antitrust lawsuit whether the Department of Justice joins his cause or not."
