Re: LB Francis Bernard Suspended?
My thoughts as an attorney and prosecutor.
1) The police were actually handling this quite well. Francis blew it by letting the noise get to a level where the police were called a second time. BUT, the end of the video with the "manager" who didn't want to leave or shut the door like the police told him to and who thought he had some "right" or "need" to watch it all leaves me with a nagging question of whether this was some punk who (for whatever reason) just doesn't like football players and made the unnecessary complaint. I find it strange that the second call does not come until Francis has returned as it is clear from the comments on the video that he left after the initial visit.
2) I find one thing the police said/did to be a little strange. They are at an apartment with 4 people who live there. There seems to be no doubt that Francis left and then came back believing/expecting the others to have left; and yet the police are ticketing Francis. Did they ticket EVERYONE who lived there? Or just Francis? They state that he is responsible for everyone that goes into his house and everything that goes on there ... ONLY if he allows it. If one of his room-mates allows it and Francis leaves, then it's not his responsibility. So, I've got some questions there.
3) Francis screwed up. Alcohol was being used, and he knows better than that. Yes, I know there's lee-way given to people, and some players abuse that. But he knew better, and his excuse was pathetic.
4) Francis asking the police to call his coach because his coach would take care of him bothers me. It certainly puts a bad light on the whole football program.
5) There is clearly some history between Francis and the "manager" ... which adds to the doubts in #1. But Francis shouldn't have responded the way he did.
6) If I owned the housing complex, I'd find that manager and fire him. NO WAY should that video have been released. It goes to demonstrate the guy is a punk with an axe to grind.
None of that really helps with the HC claims ... but a YEAR suspension? Seems rough to me.

Re: LB Francis Bernard Suspended?
I listened to it once, but my impression was the police officer was being a weasel. he said "Take the ticket quietly or I'll call your coach on you" and Bernard says - "call my coach" then officer Weasel says "what about the alcohol in here?"
People think the officer here did a good job but I don't see it. If he really was always going to give him the ticket, he should have just given him the ticket and left. Nothing good came from his lecturing Bernard. Hopefully the officer gets better training in the future.

Re: LB Francis Bernard Suspended?
The manager may indeed be a jerk with an axe to grind. But honest question here. Does he have a legal right to be where he is and film? Or to put it another way, is there a law that says he should not have been there and filming? Just because a police officer says to do something that doesn't mean it's the law.
If I'm standing in my own front door and see something going on with my neighbors, is it illegal or just immoral to film? Trust me, I don't like the idea of people recording everything and making it public (I strongly detest most vloggers who just walk around recording every moment and every place they go in their boring lives), but that doesn't necessarily make it illegal.
And Bernard (if that's him) needs some serious anger management help. This doesn't excuse anything but in this day and age you just have to assume that everything is being recorded and can be made public. Whether by the government or other individuals. Sad but true.

Re: LB Francis Bernard Suspended?
That was my same opinion. The officer baited him about calling his coach and to me FB was saying, fine, if my coach can deal with this and I won't get a ticcket, let's give him a call. Then the officer changes his tune.ABYUFAN wrote: ↑Thu Aug 31, 2017 10:09 amI listened to it once, but my impression was the police officer was being a weasel. he said "Take the ticket quietly or I'll call your coach on you" and Bernard says - "call my coach" then officer Weasel says "what about the alcohol in here?"

Re: LB Francis Bernard Suspended?
I'll agree that the officer was stupid in offering to call the coach. He thought he had a pressure point on Francis, dumb choice. That doesn't excuse my criticism above.
The officers have the right and the duty to control the scene for everyone's protection. The managers was standing around the corner of FB's apartment ... which was fine until the dip-stick put himself into the situation and made it blow up. Remember, the officers are IN FB's apartment, THEY have a right and duty to be there ... the manager? Not so much. (PERHAPS there is a) an element of the housing contract which gives him such a duty; or perhaps there is something in Utah Landlord-Tenant law that does ... I can't speak to those.) When the guy steps in and things get hot, the police had the duty to remove the manager and keep the peace.byufan4ever wrote: ↑Thu Aug 31, 2017 10:15 am The manager may indeed be a jerk with an axe to grind. Re: LB Francis Bernard Suspended?
The 'manager' is a piece of work. He releases this video, without consent of those in it, and without doing anything to change to visage or voice or anyone involved, except his own. And he releases it anonymously to a troll site. Wow. Way to have a spine, dude. If he were only interested in doing the right thing, he wouldn't have filmed this in the first place.
Francis shouldn't have done what he done. He knows that. And now thanks to this class-A jerk, so does the whole world. I'm sure glad that I'm afforded the luxury of making my mistakes (mostly) in private. I'll bet the manager is glad he's given that luxury too.

I would like to know who the manager/spineless voyeur is. It would be fun to put a video of him on the internet without his consent and change his voice. Stay classy dude!

Re: LB Francis Bernard Suspended?
So, team has cleared Bernard, police have closed the matter, his ecclesiastical endorsement has not been revoked, but the HC office is suspending him from playing football a year for this?

Re: LB Francis Bernard Suspended?
No. Not just for this. It would be best if people left it alone and let Francis have his privacy.
